Your personal data are processed and stored in accordance with the Law No. 6698 on the Protection of Personal Data (hereinafter referred to as "KVKK"). KVKK was published in the Official Gazette dated 7 April 2016 and numbered 29677. The relevant law is regulated to protect the fundamental rights and freedoms of natural persons whose personal data are processed, including the privacy of private life, which is also protected by our Constitution and Turkish Criminal Laws, and to determine the obligations of natural and legal persons who process personal data.
The purpose of our personal data protection and processing policy ("KVK Policy") is to establish management instructions and procedural requirements to ensure that YouTrack360 processes and protects personal data in accordance with the KVKK.
In accordance with the KVKK, your personal data will be collected and processed by us as the data controller within the scope described below. As YouTrack360, in accordance with the KVKK and in the capacity of Data Controller, your personal data will be recorded, stored, updated, disclosed/transferred to third parties where permitted by the legislation, classified and processed in the ways listed in the KVKK within the framework described on this page.

By accepting the Personal Data Protection Policy, you consent to the collection, storage, processing, use, domestic or international transfer of your personal data, which you have given explicit consent to share with YouTrack360 and YouTrack360's domestic and foreign business partners and users of the platform within the scope of YouTrack360 applications and services, with third parties with whom we have a contractual relationship, who have the same legal and technical responsibilities as us in terms of data protection and security, and who comply with the provisions of the relevant legislation.

6.1. Purpose
YouTrack360 undertakes to comply with the KVKK, relevant regulations and other personal data protection, processing and destruction regulations. YouTrack360 wishes to inform the relevant persons about the deletion, destruction or anonymisation of personal data within the scope of Article 7 of the KVKK and the regulation on the deletion, destruction or anonymisation of personal data dated 28 October 2017 and numbered 30224.
6.2. Definitions
Destruction: Deletion, destruction or anonymisation of personal data.
Recording Media: All kinds of media containing personal data that are fully or partially automated or processed by non-automated means, provided that they are part of any data recording system.
Anonymisation of Personal Data: Making personal data impossible to be associated with an identified or identifiable natural person under any circumstances, even by matching with other data.
Deletion of Personal Data: Deletion of personal data; making personal data inaccessible and non-reusable in any way for the Relevant Users.
Destruction of Personal Data: The process of making personal data inaccessible, irretrievable and non-reusable by anyone in any way.
Periodic Disposal: In the event that all of the conditions for processing personal data specified in the Law disappear, the deletion, destruction or anonymisation process to be carried out ex officio at recurring intervals specified in the personal data storage and destruction policy.
6.3. Scope and Recording Media
Your personal data are stored for the retention periods specified in the relevant legal regulations, for the period required by the purposes of processing if no period is specified in the relevant legal regulations, personal data obtained during the process of registering with YouTrack360 or benefiting from YouTrack360's services are stored within the scope of our personal data inventory and the obligations specified in the KVKK legislation, and then deleted, destroyed or anonymised in accordance with the KVKK.

6.4. Legal and Technical Basis for Storing Personal Data
YouTrack360 retains the personal data it processes pursuant to Article 7 of the LPPD and Article 138 of the Turkish Penal Code only for the period stipulated in the relevant legislation or for the period required by the purpose of personal data processing if no period is stipulated in the legislation. If the purpose of processing personal data has expired or the retention periods have expired, personal data may be retained only to the extent deemed necessary and required by the possible law.
Personal data processed in accordance with the provisions of KVKK and other relevant laws must be deleted, destroyed or anonymised by YouTrack360 ex officio or upon the request of the person concerned, in such a way that these data cannot be used and recovered in any way. The procedures and principles regarding the destruction or anonymisation of personal data in accordance with the law will be carried out in accordance with the principles and rules specified in the regulation.

YouTrack360 takes all technical and administrative measures specified in the law, board decisions and guidelines to prevent unlawful access to personal data, and all technical and administrative measures regarding cyber-attacks on personal data of third parties. YouTrack360 audits the security of the data inventory created in accordance with the legislation, system and software security and reports to the person authorised in this regard or to the board if requested, and ensures that personal data is protected as stipulated in the legislation.
Article 11 of the KVKK No. 6698 entered into force on 07 October 2016 and in accordance with the relevant article, the rights of the Data Subject after this date are as follows:
The Relevant Person has contacted YouTrack360 in relation to himself or herself;

- Request information if personal data has been processed,
- To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
- To know the third parties to whom personal data are transferred domestically or abroad,

- To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the KVKK,

The right to apply to our company with this form prepared in accordance with Article 11 of the KVKK belongs directly to the personal data owner. For applications to be made on behalf of third parties, a power of attorney suitable for the representation of the relevant person must be present.

This contract clause shall apply to the maximum extent permitted by applicable law. The services offered by the Company are provided on an "as is" and "as available" basis and make no warranties of any kind, express or implied, statutory or otherwise, with respect to the services or the application (including all information contained therein), including all implied warranties of merchantability, fitness for a particular purpose or non-infringement.
If one of the terms of this contract becomes partially or completely invalid, the rest of the contract shall remain valid.
youtrack360.com may change the services offered on the site and the terms of this agreement partially or completely at any time. Changes will be effective from the date of publication on the site. It is the User's responsibility to follow the changes. The User is deemed to have accepted these changes by continuing to benefit from the services offered.
All notifications to be sent to the parties regarding this Agreement will be made via the known e-mail address of youtrack360.com and the e-mail address specified by the user in the membership form. The user agrees that the address specified while becoming a member is the valid notification address, that in case of change, it will notify the other party in writing within 5 days, otherwise the notifications to this address will be deemed valid.
In all disputes that may arise between the parties for transactions related to this contract, the parties' books, records and documents, e-mail, messaging within the site, sms and computer records and fax records will be accepted as evidence in accordance with the Civil Procedure Law No. 6100, and the user agrees not to object to these records.
Istanbul Courthouse Courts and Enforcement Offices are authorised for the settlement of any dispute arising from the application or interpretation of this Agreement.
Cancellation - Refund Policy
- The CUSTOMER agrees to pay the monthly or annual subscription fee specified in the offer document (Annex-1). During the subscription period, the service will be provided to the CUSTOMER within the specified usage rights.
- Invoicing is done on a regular monthly/annual basis according to the contract date as the service start date. Payment must be completed within 7 days from the invoice date.
- The CUSTOMER accepts that the AGENCY has the right to suspend the service or terminate the contract in case of any payment delay.
- In the event that the CUSTOMER cancels the service and/or terminates the contract for arbitrary or commercial reasons, except for justified reasons; the payment amount in the invoice specified in this contract and the offer form attached to the contract shall be paid to the AGENCY in any case and shall not be refunded if it has been paid.
- The CUSTOMER may benefit from additional services (YouTube consultancy service) offered free of charge by AJANS within the scope of the marketing campaign, valid only for annual subscriptions. In the event that this agreement is terminated by the CUSTOMER before the expiry of the contract period or terminated by AJANS for just cause due to the behaviour of the CUSTOMER in breach of the contract; the service(s) offered to the CUSTOMER free of charge within the scope of the campaign shall be charged at the price list of AJANS in force on the date of termination. The CUSTOMER accepts and undertakes in advance to pay this service fee separately.
- Either party may prevent the renewal of the contract without any justification, provided that a written notice is given at least 15 (fifteen) days prior to the renewal date of the contract. However, in case of early termination within the subscription period, no refund of the remaining period shall be made.
- In the event that one of the parties does not fulfil its obligations under this contract intentionally, negligently or repeatedly, a written notice is sent to the other party and this violation is not resolved within 7 (seven) days, the contract may be terminated unilaterally for just cause.
- In the event that the payment obligations are not fulfilled by the CUSTOMER on time, the AGENCY has the right to suspend the service, temporarily stop system access or terminate the contract unilaterally, provided that 7 (seven) days prior written notice is given.
- In the event that the contract is terminated based on the justified reasons specified in this contract, the party causing the termination is obliged to cover only the documentable damages directly related to the performance of the contractual service. Indirect, incidental, punitive, special or consequential damages cannot be claimed in any way.
- In the event of termination of the Agreement, the service fees, invoiced amounts, additional service fees, if any, and periodic fees committed to be paid in advance shall be paid immediately and in advance. These debts become due and payable regardless of the date of termination.
- If the CUSTOMER has breached the contract with a defect that causes the service under the contract to be stopped, the direct costs incurred by the AGENCY for this reason (e.g. data recovery, system security breach, third party financial obligations, etc.) will also be considered within the scope of compensation.
- In case the contract is terminated for any reason; AJANS will keep the data belonging to the CUSTOMER in the system for 15 (fifteen) days from the date of termination of the service subject to the contract. At the end of this period, the CUSTOMER data will be permanently and irreversibly deleted and any backup obligation will not belong to AJANS.
- The AGENCY may temporarily or permanently stop the service and unilaterally terminate the contract in cases such as a situation contrary to the legislation of the Republic of Turkey regarding the cessation of the service before the end of the contract period, compulsory intervention of the public authority or misuse of the system.
- In case of termination of this contract for any reason, AJANS shall keep all data, content and user information on the system belonging to the CUSTOMER for 15 (fifteen) days from the date of termination of the contract. During this period, the CUSTOMER may, if he/she wishes, export his/her data or request AJANS to deliver his/her data to him/her in digital environment with a written request.
- If the delivery of the data is not requested by the CUSTOMER or after the requested data transfer is realised, all customer data will be permanently and irreversibly deleted from the system at the end of 15 (fifteen) days. After this process, the data storage obligation of the AGENCY ends.
- AJANS accepts and undertakes that it will act in accordance with the applicable data protection legislation of the Republic of Turkey (in particular the Law No. 6698 on the Protection of Personal Data) during the deletion of data, and that the deletion, destruction or anonymisation processes will be carried out within the framework of technical and legal requirements.
- The AGENCY agrees that it will not store, use, share with third parties any content belonging to the CUSTOMER after the termination of the contract and will not make any savings on the content produced or uploaded within the scope of the service.
- The CUSTOMER agrees in advance that the AGENCY shall not be responsible for any data loss that may arise in cases where the CUSTOMER does not back up the data within 15 days from the date of termination or does not request delivery in writing.
- The customer may request the delivery of the data in digital environment free of charge. However, if a special work or additional service is required during data transfer, AJANS reserves the right to charge this service separately.
